Terms of Service

Welcome to Caju. These Terms of Service ("Terms") govern your access to and use of our autism support tools platform, including our website, mobile applications, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using Caju, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Signup presents a single acceptance checkbox. By ticking it, you confirm in particular that:

  • You have read and accept these Terms and the Privacy Policy;
  • You expressly consent to Caju processing health-related information (autism support level, therapy notes, support goals) about you or about the child whose profile you create, as described in the “Health-related data” section of the Privacy Policy;
  • You understand that Caju is a support tool and not a medical service, and that it does not replace therapy or professional advice (see section 9).

You may withdraw your consent to the processing of health-related information at any time by writing to privacy@trycaju.com. Withdrawal does not affect the lawfulness of processing carried out beforehand, but we will no longer be able to provide the features that depend on that information.

2. Eligibility

To use Caju, you must:

  • Be an adult, signing up on your own behalf or as a parent, legal guardian, therapist, or educator supporting a child
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete information during registration

The Service is designed to be set up and supervised by an adult account holder. Children use the AAC and routine features through profiles configured by that account holder.

2.1 Profiles for children you are not the legal guardian of

Caju does not ask you for a separate confirmation each time you create a profile. Instead, by accepting these Terms you declare, and declare again each time you create a profile, that:

  • If you are the child's parent or legal guardian, you consent to their personal and health-related data being processed in Caju;
  • If you are not, you have obtained the explicit prior consent of that child's parent or legal guardian for that processing, and you keep documented proof of it, which you agree to show us on request.

We record the date each profile was created and the version of these Terms in force at that moment. If in any case you do not have this consent, do not create the profile: you can instead ask the legal guardian to create the account and invite you to the child's profile. If consent is withdrawn, delete the profile or write to privacy@trycaju.com.

3. Account Registration and Security

3.1 Account Creation

You must create an account to use certain features of the Service. You agree to provide accurate, current, and complete information and to update your information as necessary to maintain its accuracy.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

4. Plans and Pricing

4.1 Free for families, with no end date

Caju is free for families and will stay that way. If you are a parent, legal guardian, or anyone else caring for a child, the access to the Service you use today stays free, with no end date, and will not be moved behind a paid plan. You will never be required to pay in order to keep using features you already use. AI image and audio generation carries monthly limits, which is what makes this sustainable.

4.2 Solo professionals

Therapists, psychologists, and educators using Caju in their own practice pay nothing today. We may introduce a paid plan for individual professional use. If we do, we will give clear notice well in advance, and the commitment to families described in 4.1 remains unchanged.

4.3 Clinics, schools and hospitals

Teams can request higher monthly AI limits, priority support, and early access to new features. These arrangements are made directly with us rather than through self-serve billing. They are what funds the Service.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws, regulations, or third-party rights
  • Upload or share harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service
  • Share your account credentials with others
  • Resell or commercially exploit the Service without authorization
  • Interfere with or disrupt the Service or servers
  • Remove or modify any copyright, trademark, or proprietary notices

6. User Content

6.1 Your Content

You retain ownership of all content you create or upload to the Service (e.g., AAC boards, visual schedules, custom images). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely to provide and improve the Service.

6.2 Content Responsibility

You are solely responsible for your content and represent that you have all necessary rights to upload and use it. You agree not to upload content that infringes on intellectual property rights, violates privacy, or is harmful or offensive.

6.3 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

7. AI-Generated Content

Caju uses artificial intelligence to generate images and other content. While we strive for accuracy and appropriateness, AI-generated content may occasionally be inaccurate or inappropriate. You agree to review all AI-generated content before use and report any issues to us.

8. Intellectual Property

The Service, including all software, designs, text, graphics, logos, and other content (excluding user content), is owned by Caju and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Medical Disclaimer

IMPORTANT: Caju is Not a Medical Service

Caju is a support tool. It does not diagnose or treat any condition and does not replace professional advice.

Caju provides tools to support therapy and communication but is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified healthcare professionals regarding any medical or therapeutic concerns. Never disregard professional medical advice or delay seeking it because of information obtained through our Service.

By accepting these Terms at signup, you expressly acknowledge this disclaimer.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We do not guarantee that the Service will be error-free, secure, or uninterrupted
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
  • We are not responsible for third-party content, services, or links

11. Indemnification

You agree to indemnify, defend, and hold harmless Caju, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Termination

12.1 By You

You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service will immediately cease.

12.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Common reasons for termination include violation of these Terms, fraudulent activity, or extended periods of inactivity.

12.3 Effect of Termination

Upon termination, you will lose access to your account and all associated data. We may delete your data in accordance with our Privacy Policy and data retention practices.

13. Dispute Resolution

If you have any concerns or disputes, please contact us first at support@trycaju.com to attempt to resolve the issue informally.

These Terms shall be governed by the laws of Portugal, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Caju regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
